As the courts swell with the lenders booking spaces to repossess the great unwashed who in most cases owe the lender from 1600 to 4000 on average, we are seeing even more sharp dealings from these lending parasites who are desperate to swell their depleted coffers through the repossession of all and sundry.
The last resort is precluded by helping those facing the loss of their homes for paltry arrears amounts and a fair amount of crooked action otherwise known as “sharp practice” by the lenders and (you wont believe it) lawyers. No! I hear you cry not possible, but yes some are telling people in financial difficulties that there is no need to turn up to court!
With a N244 and some instructions you can present your own circumstances to a judge the next day and be granted an emergency hearing, at which through outlining why you are in arrears, how you plan to avoid repossession and pay off arrears and continue to pay mortgage payments, you will be given up to 56 days to prove this.
The lenders don’t want you to know how to stop your repossession action, attaching arrears to your loan for its lifetime, yes a judge has the authority to direct this and stay in your home.
A sale and rent back is a very good last resort, however there are other avenues to seek before going down this road.
The N244 is often needed to stop repossession or eviction of your home so that a recommended sale and rent back organisation can proceed with the purchase of your property to satisfy the courts, lenders and charges.
It can be heard on the same day but is almost always heard the day following your submission and it is fairly easily filled in as long as you keep your story straight, have evidence of relevant information as earnings etc and do not make anything up.
Judges are sharp and will not tolerate fabrication or blaggers. Tell him how it is and what you are going to do to resolve it even. It’s perfectly acceptable to tell they judge that you plan to rent back your home from an investor but you just need a little time to get all your ducks in a row.
In all likely hood he will be understanding and put off repossession and eviction proceedings, giving you time to take the most appropriate action.
